The School also partners with regulatory bodies and other institutions to ensure the training content is current, practical, and tailored to the realities of each sector.
4. What consultancy services are available through the CPD Department?
The department offers an extensive range of legal consultancy services, including legal audits, governance audits, data protection impact assessments (DPIAs), regulatory impact assessments (RIAs), and the drafting of legislation (Bills) and policy. These services are grounded in robust legal analysis and tailored to support compliance, institutional efficiency, and sound policy-making.
5. What is a Legal and Governance Audit, and who requires it?
A legal audit is a comprehensive assessment of an institution’s adherence to relevant laws, regulations, as well as the Constitution of Kenya 2010. These audits help organizations identify legal obligations, mitigate liability, and improve service delivery and operational integrity. For state corporations in Kenya, such audits are not optional—they are mandated by the Mwongozo Code of Governance 2015, which requires annual legal compliance audits and comprehensive legal audits every two years. Governance audit examines the governance structures and how they enhance the effectiveness of service delivery. There are about eight parameters which are focused on for governance audits.
6. What is a Data Protection Impact Assessment (DPIA)?
A DPIA is a process required under Kenya’s Data Protection Act, designed to identify and reduce risks associated with the processing of personal data. It is particularly necessary for high-risk processing activities. The CPD Department helps organizations to carry out DPIAs and build robust data protection compliance frameworks to safeguard the privacy rights of data subjects, and hence reduce possible liability at the suit of third parties.
7. What is a Regulatory Impact Assessment (RIA)?
An RIA is a systematic approach to evaluating the likely benefits and costs of a new or existing regulation. It ensures that policies are transparent, efficient, and justified. KSL supports institutions in conducting RIAs in line with the requirements of the Statutory Instruments Act, helping to ensure better regulatory decision-making.
8. What support does the School provide in legislative and policy drafting?
The CPD Department offers legal and technical assistance in drafting bills/laws and policies. This includes providing legal advice, conducting contextual research, engaging stakeholders, and incorporating international best practices. The goal is to develop legislation and policies that are clear, effective, and resilient to public and legal scrutiny.
9. Who are some of the CPD Department’s past clients?
The department has served a wide range of clients over the past decade, including state corporations and regulatory agencies such as the Sacco Societies Regulatory Authority (SASRA), Kenya Maritime Authority, National Environment Management Authority (NEMA), Capital Markets Authority, Kenyatta National Hospital, SONY Sugar, Privatization Authority, Teachers Service Commission, Coca Cola, Tourism Fund and Kenya Airports Authority, among many others. Their continued engagement reflects confidence in the department’s legal expertise and service quality.
